This is a joint submission (by CHOICE, Financial Rights Legal Centre, FCA, CALC, CCLS, Redfern Legal Centre, EARG, FCVic, FCAN and Care) commenting on the changes made in the Draft Regulations to the cap on default (late) fees, which for certain BNPL models permits the annual cap on late fees to be more than double the previous proposal. Specifically, it comments on how the increased late fees will reduce the extent to which these laws protect BNPL users in financial hardship.
